Amendments to schedule of export and import tariffs from December 16, 2024; applications for participation in voluntary occupational accident insurance from January 1, 2025; Ministry of National Defense of Vietnam’s guidelines for selecting and conscripting citizens in 2025, etc. are notable contents that will be covered in this bulletin.

1. Vietnam’s amendments to schedule of export and import tariffs from December 16, 2024 

This is a content of Decree No. 144/2024/ND-CP dated November 1, 2024 on amendments to Decree No. 26/2023/ND-CPꦇ on the schedule of export tariffs, schedule of preferential import tariffs, tariff nomenclature, and fixed duties, mixed duties, and out-of-quota import duties promulgated by the Government of Vietnam. 

According to the Decree, the export tariff rates and preferential import tariff rates applicable to specific products prescribed in Appendix I – schedule of export tariffs, Appendix II – schedule of preferential import tariffs under the Nomenclature of Taxable Products prescribed in Article 3 of Decree No. 26/2023/ND-CP are amended into new export tariff rates and preferential import tariff rates prescribed in Appendix I and Appendix II enclosed with Decree No. 144/2024/ND-CP.

The preferential import tariff rates applicable to products of heading 24.04 and products with assigned HS code 8543.40.00 in Appendix II of the schedule of preferential import tariffs under the Nomenclature of Taxable Products enclosed with Decree No. 144/2024/ND-CPꦛ shall be applied in cases where such products are permitted for import into Vietnam under the law.

2. Applications for participation in voluntary occupational accident insurance in Vietnam from January 1, 2025

On November 1, 2024, the Government of Vietnam promulgated Decree No. 143/2024/ND-CPಞ on voluntary occupational accident insurance for workers not under labor contracts. 

According to the Decree🗹, from January 1, 2025, applications for first-time participation in voluntary occupational accident insurance are statements on participation in social insurance of workers, which contain specific information on the professions, jobs, working time, and workplaces registered for participation in voluntary occupational accident insurance. 

ꦓWhere there are changes to the professions, jobs, working time, and workplaces, declare adjustments to information as per regulation. Applications for adjustments to the personal information of workers participating in voluntary occupational accident insurance include: 

𝔍- Statements on adjustments to personal information; 

- Social insurance books; 

🦋- Copies of papers of competent state authorities and other papers relevant to adjustments to personal information according to the law.

3. Ministry of National Defense of Vietnam’s guidelines for selecting and conscripting citizens in 2025 

On October 31, 2024, the Ministry of National Defense of Vietnam promulgated Guidance No. 4705/HD-BQP on selecting and conscripting citizens in 2025.

Specifically, to achieve the drafting quota for 2025 and ensure quality and compliance with the Law on Military Service 2015𒁏, the Ministry of National Defense of Vietnam provides guidelines on several contents of the drafting work in 2025 as follows: 

- Provinces and units shall continue to disseminate and strictly implement the Law on Military Service 2015; Circular No. 148/2018/TT-BQP; Circular No. 105/2023/TT-BQP🦩; documents guiding the implementation of the Law; Directive No. 98/CT-BQP 2019, and professional documents of competent authorities of the Ministry of National Defense of Vietnam. 

- Local authorities shall: 

♚+ Successfully carry out the military service registration and management of citizens within the military service age; improve the quality of the nomination and proposal for male citizens within the military age to attend the military service pre-qualifications, ensuring democracy, equality, and publicity; 

+ Assess and approve citizens subject to military service exemption or postponement, citizens eligible for conscription in a strict and serious manner to ensure proper subjects and prevent loss of conscription sources (the health standards for citizen selection and conscription in 2025 shall comply with Point a Clause 1 Article 4 of Circular No. 105/2023/TT-BQP; eye standards shall comply with Point c Clause 3 Article 4 of Circular No. 148/2018/TT-BQP).

ཧ+ Prioritize the selection of citizens graduated from universities and colleges with professions comfortable with allocation and use needs to select high-quality conscription sources, meeting the requirements for tasks of developing the Military in the new situation; select people of ethnic groups (less than 10.000 people) to create sources of local officials; ensure that all communes, wards, and commune-level towns have drafted citizens; prioritize the allocation of drafting quotas conformable with each province in association with encouragement areas of units up to the district-level.

4. General requirements for management of quality of building materials in Vietnam from December 16, 2024 

This is a content of Circular No. 10/2024/TT-BXDܫ on the management of the quality of building materials promulgated by the Minister of Construction of Vietnam.  

According to the Circular, building materials shall ensure the quality as prescribed in Clause 1 Article 7 and Article 10 Chapter III of Decree No. 09/2021/ND-CP; announce applicable standards under the law on product and goods quality; comply with the regulation on origin tracing under Circular No. 02/2024/TT-BKHCN.

Where: 

- Regarding building materials of group 1: 

+ Apply the quality management system to ensure that the quality of products conforms with the corresponding technical standard and conduct labeling according to Article 4 of Circular No. 10/2024/TT-BXD before listing products on the market. 

+ Voluntarily declare the conformity of products and goods with the corresponding standard. The declaration of standard conformity shall comply with the guidance in Chapter II of Circular No. 28/2012/TT-BKHCN, Circular No. 02/2017/TT-BKHCN, and Article 11 of Circular No. 10/2024/TT-BXD.

- Regarding building materials of group 2: 

+ Apply the quality management system to ensure that the quality of products conforms with the corresponding technical regulation and conduct labeling according to Article 4 of Circular No. 10/2024/TT-BXD before listing products on the market. 

+ Compulsorily declare the conformity of products and goods with the corresponding regulation. The declaration of regulation conformity shall comply with the guidance in Chapter II of Circular No. 28/2012/TT-BKHCN, Circular No. 02/2017/TT-BKHCN, and Article 12 of Circular No. 10/2024/TT-BXD.
